We reserve the right to refer orders to Elgi Rubber Company distributors. Prices are subject to change without prior notice. All prices are quoted F.O.B. Luling, TX, U.S.A. or Elgi Rubber Company distribution centers.

Terms:
Net 30 days from the date of invoice, payable in the U.S. currency upon approved credit within predetermined limits. Late/delinquency fees will be applied to any delinquent account deemed as past due.

Warranty:
Elgi Rubber Company U.S.A. makes no guarantee or warranty, expressed or implied, of products sold to the merchantability or suitability for specific purpose or condition. Elgi Rubber Company disclaims, and acknowledges and agrees thereto, any and all liability on the part of Elgi Rubber Company with respect thereto or arising there from, and except as expressly set forth herein, Elgi Rubber Company shall not be liable or responsible for any damage, defect, failure to meet certain specifications, late delivery or failure of the goods to operate as intended or warranted. Elgi Rubber Company shall not be responsible or liable for any damage, loss, claim, or expense of any nature, including but not limited to special, consequential or incidental damages or loss of profits, of revenue, caused directly or indirectly, whether actual or anticipated, by the goods sold or distributed or the inadequacy thereof, or the interruption or loss of the service or use thereof, or arising from any reason or cause whatsoever relating to or concerning the goods sold hereunder. Elgi Rubber Company warrants that for a period of 90 days from delivery, goods distributed by Elgi Rubber Company will be free from defects in material and workmanship and will conform to the specifications designated therefore, provided that the product has been properly installed, handled, and maintained. Provided customer notifies Elgi Rubber Company of such defect within 90 days from the receipt of goods. Other manufacturers goods sold or distributed by Elgi Rubber Company may be subject to the manufacture warranties that may supersede any warranty expressed or implied by Elgi Rubber Company. The exclusive remedy for any product found to be defective under this warranty is limited to Elgi Rubber Company and its option and expense, will either issue credit, refund, replace or repair such defective goods. Elgi Rubber Company shall not be liable for any consequential or incidental damages, including labor charges.

Returns:
A returned good authorization (RGA) number must be obtained from Elgi Rubber Company for any return to be considered. Returns without an RGA number will be refused. Return freight charges are the responsibility of the purchaser and must be shipped freight prepaid with 30 days of obtaining the RGA number for claim consideration. A minimum restock and handling fee of 25% will be charged for all merchandise returns except for incorrect shipments or defective products determined by Elgi Rubber Company at their discretion. Returned goods and merchandise must be received in original packaging and resalable condition. Any special order, obsolete or discontinued goods may not be returned and are the responsibility of the purchaser. All merchandise for return or warranty consideration including rubber goods and chemicals are to be handled and stored in the proper environment and must be free from contamination. Temperature sensitive products, such as vulcanizing or curing gums, or rubber products may not be returned. Any abuse, alteration or modification of which the product was not intended for will be cause for rejection. Products older than 90 days of original purchase will not be authorized regardless of condition.
